1. Introductory Provisions
1.1. These general terms and conditions (the “Terms”) govern the rights and obligations between the operator of the IB Lab platform (the “Provider”) and natural or legal persons using the platform (the “User”).
1.2. Provider details:
- Trade name: Desmond Akahomen
- Company ID (IČO): 08113912
- Registered office: Chrudimská 1575/6, 130 00 Praha 3
- Registration: Registered in the Trade Licensing Register kept by the Úřad městské části Praha 3 (Prague 3 District Office)
- Contact e-mail: support@iblab.io
- Website: https://iblab.io
1.3. IB Lab is an online software platform provided as Software as a Service (SaaS), offering historical market data, statistical analyses, analytical tools and related functionality focused on financial markets.
1.4. By using the platform and entering into the contract, the User confirms that they have read these Terms. The contract is concluded in Czech, unless expressly stated otherwise when the order is placed.
1.5. Where the User is a consumer, the relevant provisions of consumer protection law apply to them. Nothing in these Terms limits the consumer's mandatory statutory rights.
2. Nature and Scope of the Service
2.1. IB Lab provides in particular:
- Historical and statistical financial market data.
- Analyses of market behaviour and historical probabilities.
- Tools for evaluating trading strategies.
- Analytical overviews and other functionality available under the chosen subscription.
2.2. The specific scope of functionality depends on the current offering and the chosen plan.
2.3. The service is provided online through an internet browser. Using it requires a working internet connection, a compatible device and a current version of a common web browser (for example Chrome, Firefox, Safari or Edge).
2.4. The Provider may develop and update the platform and add new features. Changes to the digital service that go beyond those necessary to keep it in conformity with the contract are governed by the applicable legislation. If a change negatively affects the User's access to or use of the service in a way that is more than minor, the User will be informed and will be granted the applicable statutory rights.
2.5. The Provider will ensure the updates necessary for the service to remain in conformity with the contract for the period required by law.
3. Registration and User Account
3.1. Using IB Lab requires creating a user account.
3.2. The User is obliged to provide truthful and up-to-date information and to protect their login credentials from unauthorised access.
3.3. The user account is intended solely for the registered User. Without the Provider's prior written consent, sharing, transferring, renting or reselling the account to third parties is not permitted.
3.4. The User is responsible for the use of the account to the extent provided by law. If the User suspects unauthorised access, they should contact the Provider without undue delay.
3.5. In the event of a serious or repeated breach of the Terms, the Provider may restrict or suspend access to the account in a proportionate manner. Where possible, the User will be informed in advance and given an opportunity to remedy the breach. This does not affect the User's statutory rights.
4. Conclusion of the Contract
4.1. The contract is concluded at the moment the Provider confirms the order or makes the ordered service available, whichever occurs first, unless the ordering process expressly provides otherwise.
4.2. Before submitting the order, the User is informed in particular of the chosen plan, the price, the length of the billing period, automatic renewal, the terms of the trial period and the way to cancel.
4.3. Before completing the order, the User has the opportunity to review and correct the data entered.
4.4. An order that creates an obligation to pay must be confirmed in a way that clearly draws attention to that obligation, for example with a button labelled “Order with obligation to pay”. For a trial period, the arising of the subsequent payment obligation must be clearly explained.
4.5. Confirmation of the conclusion of the contract and the relevant contractual information will be sent to the User electronically, to the e-mail address they provided, in a form that allows them to be retained.
5. Prices and Subscription
5.1. IB Lab is provided through a paid subscription, in particular in the following variants:
- Monthly subscription.
- Annual subscription.
5.2. Current prices, currency, VAT information and any additional fees are stated on the website before the order is completed. For consumers, the total price including the applicable taxes is displayed. The Provider is not a VAT payer; the stated prices are final.
5.3. The subscription is charged in advance for the relevant billing period.
5.4. Unless the User cancels the subscription, it renews automatically for a further period of the same length, on the terms communicated at the time of the order or subsequently validly changed in accordance with the law.
5.5. When activating the subscription, the User consents to recurring payments through the chosen payment method. The consent can be withdrawn by cancelling the automatic renewal of the subscription. The details are governed by the Recurring Payment Terms.
5.6. Price changes do not affect a period that has already been paid for. The User will be informed in good time of a price change for the following period and will be able to cancel the subscription before the change takes effect.
5.7. Payment transactions are processed by an external payment service provider. The IB Lab Provider does not process complete payment card data where such data is entered directly into the payment provider's secure environment.
6. Seven-Day Free Trial Period
6.1. New eligible Users may be offered a free trial period of seven calendar days.
6.2. Activating the trial period requires entering a valid payment card.
6.3. The subscription price is not charged for the trial period itself.
6.4. If the User does not cancel the subscription during the trial period, a paid subscription under the chosen plan will start automatically once it ends and the first payment will be made.
6.5. The exact moment the trial period ends and the amount of the subsequent payment will be communicated to the User before the trial period is activated.
6.6. The User may cancel the subscription at any time during the trial period. If they do so before it ends, the first subscription payment will not be charged.
6.7. After cancellation during the trial period, access remains active until the end of the trial period, unless stated otherwise and without prejudice to the User's statutory rights.
6.8. The Provider may restrict repeated use of the trial period, in particular where multiple accounts are created in order to circumvent the rules of the offer. Such restrictions must be communicated to the User in advance.
7. Cancellation and Termination of the Subscription
7.1. The User may cancel the subscription at any time through their account settings, or by contacting customer support at support@iblab.io.
7.2. Cancelling the subscription stops its automatic renewal.
7.3. If the User cancels a subscription that has already been paid for, they keep access to IB Lab until the end of the currently paid period.
7.4. After the paid period ends, the User loses access to the paid features of the platform unless they reactivate the subscription.
7.5. Cancelling the automatic renewal alone does not give rise to a claim to a proportionate refund of the price for the unused part of the paid period. This does not affect the statutory rights of withdrawal, complaint, price reduction or other rights arising from defective performance.
7.6. The User will receive confirmation of the cancellation of the subscription electronically.
7.7. If a recurring payment cannot be processed, the Provider may ask the User to update their payment details and may proportionately restrict access after the paid period ends. Any further payment attempts are governed by the terms communicated to the User.
8. Withdrawal from the Contract and Refunds
8.1. A User who is a consumer has, in principle, the right to withdraw from a contract concluded by means of distance communication within 14 days of its conclusion, unless the law provides for an exception.
8.2. The withdrawal period is generally counted from the conclusion of the contract, not anew from each payment or automatic renewal of the subscription.
8.3. IB Lab is a digital service provided online. Whether a statutory exception to the right of withdrawal can be applied depends on the nature of the particular performance and on the fulfilment of the statutory conditions, in particular proper prior information, the User's express consent where applicable, and confirmation of that consent where required.
8.4. If the service is provided before the withdrawal period expires at the consumer's express request and the consumer subsequently validly withdraws, an obligation may arise to pay a proportionate part of the service already provided, but only in the cases and under the conditions laid down by law.
8.5. For digital content not supplied on a tangible medium, the right of withdrawal may lapse once performance has begun, provided all the statutory conditions of the relevant exception are met. Agreeing to these Terms does not replace any separate express consent required by law.
8.6. To exercise the right of withdrawal, the User may send an unambiguous notice to the e-mail address support@iblab.io or to the Provider's registered office address. The User may use the model form set out in the appendix to these Terms, but its use is not mandatory.
8.7. If a refund becomes due, the relevant amount will be refunded no later than 14 days after the withdrawal takes effect, as a rule by the same means of payment as was used for the original transaction, unless the parties agree otherwise and provided the User does not incur additional costs.
8.8. The Provider does not offer any voluntary money-back guarantee beyond the consumer's statutory rights.
8.9. Rights arising from defective performance, claims for non-provision of the service and other statutory claims of the User are not affected by this provision.
9. Complaints and Rights from Defective Performance
9.1. The Provider is responsible for the digital service being in conformity with the contract, in particular with the agreed description, functionality and other statutory requirements.
9.2. The User may make a complaint in particular about the non-functioning of agreed features, the impossibility of accessing the service or other defects for which the Provider is responsible.
9.3. A complaint can be submitted to the e-mail address support@iblab.io. It is recommended to state the account identification, a description of the problem and the date it occurred.
9.4. In the case of a justified complaint, the User has the right to have the service brought into conformity with the contract or, where applicable, to a proportionate price reduction or to withdraw from the contract under the statutory conditions.
9.5. Consumer complaints will be handled, and consumers informed of the outcome, no later than within 30 days, unless the parties expressly agree on a longer period.
9.6. The Provider cannot exclude or limit in advance its statutory liability for defects of the digital service towards a consumer.
10. Trading and Investment Risk Warning
10.1. IB Lab is statistical and analytical software intended for working with historical market data and for research and educational purposes.
10.2. IB Lab does not provide individualised investment advice, personal investment recommendations or portfolio management services.
10.3. The information, statistics, charts, probability calculations and other outputs of the platform do not constitute an instruction to buy or sell financial instruments or a guarantee of any particular trading result.
10.4. Historical performance and statistical probability are not a reliable guarantee of future results.
10.5. Trading on financial markets, in particular in futures contracts and other leveraged instruments, involves a significant risk of financial loss.
10.6. The User decides independently on their trading activities and bears the risks associated with their own investment decisions.
10.7. The Provider is not liable for trading losses arising from the User's independent decisions merely because the User used statistical information from the platform when making them. This provision does not exclude liability that cannot be excluded by law.
10.8. The Provider does not guarantee the achievement of profit, any particular win rate, successful completion of a prop trading evaluation, obtaining a funded account or receiving a payout.
11. Statistical Data and Its Interpretation
11.1. The statistical outputs of IB Lab are based on the available historical data, the methodologies used, the filter settings and other analytical parameters.
11.2. Results may be affected by the quality of the input data, the choice of time period, the market environment and the methodology used.
11.3. The User acknowledges that statistical results may differ from actual trading results, in particular because of spread, slippage, fees, liquidity and differing execution.
11.4. The Provider may correct data errors it identifies, update methodologies and supplement historical datasets, while respecting its contractual obligations and the Users' statutory rights.
11.5. The Provider does not guarantee that historically observed probabilities will hold in future market conditions.
12. Licence and Protection of Intellectual Property
12.1. All software, graphical interface, source code, documentation, proprietary analytical outputs, database structures and other protected components of the platform are the property of the Provider or the respective rights holders.
12.2. For the duration of authorised access, the User obtains a limited, non-exclusive, non-transferable licence to use the platform for their own internal purposes within the scope of the agreed subscription.
12.3. Without the Provider's prior written consent, the following in particular are prohibited:
- Mass copying or downloading of databases and datasets.
- Systematically extracting data by means of automated tools.
- Reselling or publicly distributing protected data.
- Sharing access credentials with third parties.
- Circumventing technical and security measures.
- Copying, modifying or distributing the software without authorisation.
- Creating competing database products by unauthorised extraction of substantial parts of protected databases.
12.4. This restriction does not apply to conduct that cannot be prohibited by contract under mandatory legislation, nor to independently obtained information that is not protected by the relevant rights.
12.5. The User may use individual statistical findings for their own trading research and decision-making. Public presentation of limited outputs for non-commercial educational purposes is permitted, provided it does not infringe the Provider's rights, the rights of third parties or these rules.
13. Availability and Technical Operation
13.1. The Provider strives for continuous availability of the service, but does not guarantee uninterrupted operation without any technical interruption.
13.2. Planned maintenance, updates and technical shutdowns may occur. The Provider will inform of significant planned restrictions in a reasonable manner, where possible.
13.3. In the event of an outage, the Provider undertakes to make reasonable efforts to restore functionality.
13.4. Temporary technical limitations do not by themselves automatically give rise to a claim to a refund of the full price. However, the User's rights arising from defective performance, from unavailability of the service or from breach of the contract remain intact.
14. Liability
14.1. The Provider is liable for breaches of its obligations to the extent provided by law.
14.2. The Provider is not liable for the consequences of the User's incorrect interpretation of statistical data, unless the Provider has at the same time breached its obligations.
14.3. The Provider is not liable for circumstances beyond its reasonable control, to the extent that the applicable legislation exempts it from liability.
14.4. Nothing in these Terms excludes or limits statutory liability for defects of the digital service, for harm caused intentionally or by gross negligence, or any other liability that the law does not allow to be limited.
15. Personal Data and Privacy
15.1. The Provider processes Users' personal data in accordance with the GDPR and the applicable legislation.
15.2. The data processed may include in particular identification and contact details, account data, subscription information, payment identifiers, technical records and data entered by the User into the platform.
15.3. The data is processed in particular for the purposes of providing the service, account administration, handling payments, fulfilling legal obligations, securing the platform and communicating with Users.
15.4. Detailed information on the purposes, legal bases, recipients, retention periods, any transfers of data outside the European Economic Area and the rights of data subjects is set out in a separate document, the Privacy and Cookie Policy.
15.5. The User may exercise their rights regarding personal data through the Provider's contact e-mail.
15.6. The use of cookies and similar technologies is described in the Privacy and Cookie Policy.
16. User Data and Termination of Access
16.1. The User remains entitled to their own data entered into the platform to the extent provided by law.
16.2. After the subscription ends, access to paid features may be restricted, including the User's analytical overviews and records.
16.3. The User may request access to their data to which they are entitled under the law. The Provider will assess and handle the request within the applicable statutory period.
16.4. The end of the subscription does not by itself mean the immediate deletion of all personal data. Some data may be retained for the time necessary to fulfil legal obligations or to protect legitimate rights.
16.5. The rules on retention and deletion of user data are specified in the Privacy and Cookie Policy.
17. Out-of-Court Resolution of Consumer Disputes
17.1. If a dispute arises between the Provider and a User who is a consumer, the parties may first try to resolve it amicably through customer support.
17.2. The Česká obchodní inspekce (Czech Trade Inspection Authority) is competent for the out-of-court resolution of consumer disputes:
Česká obchodní inspekce
Štěpánská 567/15
120 00 Praha 2
Web: https://www.coi.cz
ADR: https://adr.coi.cz
17.3. The consumer's right to turn to the competent court is not affected by this.
18. Changes to the Terms and Conditions
18.1. The Provider may change these Terms in a reasonable manner, in particular because of changes in legislation, security requirements, the technical operation of the platform or its development.
18.2. Users will be informed of material changes with reasonable advance notice by e-mail or through the user interface.
18.3. Changes must not unilaterally deprive Users of rights already acquired without an appropriate legal reason.
18.4. If a change requires the User's consent or gives rise to a right to terminate the contract, the Provider will proceed in accordance with the applicable legislation.
19. Final Provisions
19.1. The legal relationships between the Provider and the User are governed by the law of the Czech Republic, without depriving a consumer of the protection afforded by the mandatory provisions of the law that apply to them under the relevant conflict-of-law rules.
19.2. If any provision of these Terms becomes invalid or ineffective, this does not affect the validity of the remaining provisions, unless the nature of the matter implies otherwise.
19.3. These Terms are available on the iblab.io website and the User can save them in electronic form.
19.4. These Terms take effect on 17 October 2026.
